Welcome to Umwelt App! These Terms of Service ("Terms") govern your access to and use of the Umwelt App mobile application, website, and related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will also refer to that organization.

2. User Accounts

Account Creation: You may be required to create an account to access certain features of the Service. You must provide accurate and complete information when creating your account.
Authorization: You confirm that you are authorized to create an account and use the Service. If you are creating an account on behalf of someone else, you confirm that you have permission to do so.
Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.
Account Termination: We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

3. Use of the Service

3.1 Permitted Use:

You may use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Conduct: You agree not to:

Use the Service in any way that violates any applicable law or regulation.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Interfere with or disrupt the Service or servers or networks connected to the Service.
Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service.
Use any automated system, including without limitation, "robots", "spiders", "crawlers", or "offline readers", to access the Service.
Collect or harvest any personally identifiable information, including account names, from the Service.
Transmit any viruses, worms, or other malicious code.

You agree that you will not, and will not attempt to, reverse engineer, decompile, or disassemble the Service or any of its software or code. This means you cannot try to take the app apart to see how it works. This is to protect our intellectual property and keep the Service secure.

4. Content

User Content: You may be able to submit, upload, publish, or display content ("User Content") to the Service. You retain ownership of your User Content.

License to Umwelt App: By submitting User Content, you grant Umwelt App a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.
Content Responsibility: You are solely responsible for your User Content and the consequences of submitting it. You represent and warrant that you have all necessary rights, including copyright, to grant the licenses in this section.
Umwelt App's Rights: Umwelt App has the right to remove or modify any User Content for any reason, including if it violates these Terms.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Umwelt App and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. Umwelt App makes no warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Umwelt App does not warrant that the service will be service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Umwelt App be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not Umwelt App has been informed of the possibility of such damage.

Umwelt App provides information related to travel. However, Umwelt App is not responsible for any injuries, accidents, losses, damages, or other liabilities that may occur during your travel. You acknowledge and agree that travel involves inherent risks, and you are solely responsible for your safety and well-being during any travel activities. This includes, but is not limited to, injuries sustained while participating in activities, accidents during transportation, and losses due to unforeseen circumstances. Umwelt App is not liable for the actions or omissions of any third-party providers, such as airlines, hotels, or tour operators.

8. Indemnification

You agree to indemnify and hold Umwelt App harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your use of the Service, your User Content, or your violation of any law or the rights of a third party.

9. Changes to These Terms

Umwelt App reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
